Challenger Fit

1. Introduction

These Terms of Use (“Terms”) govern your use of the Challenger Fit mobile application (the “App”, “Service”), operated by Darya Davidyuk (“we”, “us”, “our”).

By using the App, you confirm that you have read and accepted these Terms. If you do not agree, you must not use the App.

2. Eligibility

You may use the App only if:

  • you are legally capable of entering into binding agreements;

  • your use is not prohibited by law;

  • the information you provide is accurate and up to date.

You are responsible for maintaining the confidentiality of your account.

 

3. Accounts and Profiles

You agree not to:

  • impersonate others;

  • use unauthorized data;

  • provide false information;

  • use the App unlawfully.

We may suspend or terminate accounts for violations.

 

4. Fitness and Health Disclaimer

The App provides fitness-related content.

You acknowledge that:

  • the App is not medical advice;

  • you use it at your own risk;

  • you should consult a physician before starting any program;

  • the Digital Wellbeing feature, if enabled, is a voluntary self-regulation tool and does not constitute medical, psychological, or therapeutic advice.

We are not responsible for injuries or health issues.

 

5. Activity Tracking and Challenges

The App may track workouts, steps, and progress.

You understand:

  • data may not always be accurate;

  • technical issues may occur;

  • results may be adjusted in case of error or misuse.

 

6. Points, Rewards, and Store

Points and rewards:

  • are not money or financial instruments;

  • are not redeemable unless stated;

  • may be modified or revoked;

We may cancel or adjust rewards if needed.

 

7. User Content

You may post content in the App.

You agree that:

  • you are responsible for your content;

  • you have rights to share it;

You grant us a license to use your content to operate the Service.

 

8. Prohibited Conduct

You may not:

  • break laws

  • post harmful or abusive content

  • cheat or manipulate activity

  • interfere with the App

 

9. Moderation

We may:

  • remove content

  • restrict accounts

  • limit features

without prior notice when necessary.

 

10. Privacy

Your use of the App is governed by our Privacy Policy.

 

11. Third-Party Services

We may rely on third-party services.

We are not responsible for their actions or availability.

 

12. Availability

We may modify or discontinue the App at any time.

We do not guarantee uninterrupted service.

We do not guarantee that:

 

- the App will always function without interruption or defects;

- calculations, step counts, notifications, challenge progress, or workout metrics will always be accurate;

- any content, feature, reward, bonus, order, or internal store item will always remain available.

 

13. Disclaimer of Warranties

The App is provided “as is”.

We make no guarantees regarding:

  • accuracy

  • availability

  • performance

14. Limitation of Liability

To the maximum extent allowed by law, we are not liable for:

  • indirect or consequential damages

  • loss of data or profits

  • injuries related to use

  • third-party issues

15. Indemnification

You agree to indemnify us from claims arising from:

  • your use of the App

  • your content

  • violations of these Terms

  • your violation of law or third-party rights.

 

16. Termination

We may suspend or terminate access at any time.

17. Apple App Store

If using iOS:

  • Apple is not responsible for the App

  • Apple has no maintenance obligations

  • the Digital Wellbeing feature uses Apple's Family Controls / Screen Time framework as permitted under Apple's entitlement for self-regulation use cases; the device owner is solely responsible for configuring and managing this feature.

 
17a. Digital Wellbeing Feature — Terms of Use

Challenger Fit offers an optional Digital Wellbeing feature that allows the device owner to set voluntary, self-imposed limits on distracting apps, unlocked by completing a physical activity break.

By enabling this feature, you agree that:

  • you are the device owner and are configuring these limits for yourself, voluntarily;

  • the feature is not intended for monitoring, restricting, or controlling another person's device or activity without their knowledge and consent;

  • we do not collect, access, or store any data about your app usage, screen time, or the specific apps you choose to restrict;

  • the feature operates locally on your device and functions through Apple's Screen Time / Family Controls framework;

  • we are not responsible for any unintended app restrictions, missed notifications, or access issues that may arise from your use of this feature;

  • you may disable the feature at any time through the app or your device settings.

Misuse of this feature — including any attempt to use it to restrict or monitor another person's device without their explicit consent — is a violation of these Terms and may result in account suspension.

18. Governing Law

These Terms are governed by the laws of the United States and the State of Florida.

 

19. Changes

We may update these Terms. Continued use means acceptance.
